Allahabad High Court

SANT KUMAR YADAV AND 2 OTHERSversusPRESIDING OFFICER, MOTOR ACCIDENT CLAIM TRIBUNAL AND 2 OTHERS

Decided

Holding

The Court granted the writ of mandamus, directing the Tribunal to decide the pending case within one year.

Summary

Petitioner Sant Kumar Yadav and others filed a writ petition seeking a mandamus directing the Presiding Officer of the Motor Accident Claims Tribunal (South), Kanpur Nagar to decide a pending M.A.C.P. case (No. 136 of 2021) that had remained undecided since 2021. The petition argued that the prolonged delay served no useful purpose and that the tribunal should be compelled to render a decision expeditiously. The Court examined whether it could issue a writ of mandamus to a quasi‑judicial tribunal to enforce timely disposal of a pending case. Finding that the delay was unjustified and that the tribunal had a duty to decide the matter, the Court issued a direction for the tribunal to decide the case within one year of the order, subject to service of notice and hearing. The petition was consequently disposed of with the mandated direction.
