Allahabad High Court
MAHAVIR YADAVversusSTATE OF UP AND ANOTHER
- Decided
Holding
The petition is disposed, with the petitioner directed to file a fresh representation and the District Magistrate ordered to decide it within a month.
Summary
The petitioner, Mahavir Yadav, filed a writ petition alleging that the District Magistrate of Jaunpur had failed to issue him a character certificate despite multiple representations. The respondent State of U.P. argued that the petition could be disposed of without merits and suggested a direction for the magistrate to consider the grievance. The Court, without delving into the substantive merits, dismissed the petition but permitted the petitioner to file a fresh representation, accompanied by a certified copy of the order, within one month. The Court directed the District Magistrate to decide the fresh representation within one month, citing the precedent of Anil Kumar v. State of U.P. (Writ‑C No.718 of 2025). The order was signed by Judges Sudhanshu Chauhan and Saral Srivastava on 19 March 2026.
