Allahabad High Court

MUMTAZ AHAMDversusPURVANCHAL VIDHUT VITRANA NIGAM VARANASI AND ANOTHER

Decided

Holding

The petition is disposed of, with the petitioner directed to file a representation and the respondent required to decide it after giving notice and hearing.

Summary

The petitioner applied for an electricity connection which was rejected by the second respondent, the Executive Engineer, without any notice. The petitioner filed a writ petition challenging the rejection. The respondents argued that the petition was of no utility and sought a direction to the petitioner. The Court, without delving into the merits, directed the petitioner to file a detailed representation against the rejection, attaching a certified copy of the order, within two weeks. It further ordered the respondent to consider the representation, give due notice and a hearing, and decide the matter within one month in accordance with law. The writ petition was therefore disposed of without a substantive hearing on the merits.
