Allahabad High Court

JAI PRAKASHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the petition requires a factual enquiry and ordered a fresh representation before the authority, disposing the writ petition.

Summary

The petitioner, Jai Prakash, filed a writ petition seeking allotment of 6% developed abadi land from his acquired land in Gautam Budh Nagar. The petition alleged entitlement to specific parcels of land measured in hectares. The Court observed that the matter required a factual enquiry and declined to decide on the merits at this stage. It directed the petitioner to make a fresh representation before the Greater Noida Industrial Development Authority within two weeks, attaching a copy of the order. The authority was instructed to render a reasoned decision within six weeks. Consequently, the writ petition was disposed without a substantive ruling on the claim.
