Allahabad High Court

LILY ROY AND ANOTHERversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The court held that the petitioners must submit the required documents within three weeks and the bank must decide within six weeks, after which the writ petition is disposed.

Summary

Lily Roy and another filed a writ petition alleging a wrongful withdrawal of Rs.11,75,600 by cheque no.530764. The respondents, including the State of U.P. and Punjab and Sind Bank, sought production of certain documents under a letter dated 6‑Nov‑2017. The petitioners claimed they had already submitted the required documents to the bank, but the court found that the documents were not placed on record. Consequently, the court directed the petitioners to file the necessary papers within three weeks, attaching a certified copy of the order. The bank was then instructed to consider the matter and decide within six weeks, and the writ petition was disposed with these directions.

Issues considered

  • Whether the petitioners are obligated to produce the documents requested by Punjab and Sind Bank under its 6‑Nov‑2017 letter.
  • Whether the writ petition can be disposed pending the submission of those documents and the bank's subsequent decision.
