Allahabad High Court
NAVEEN KUMARversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The order dismissing the petitioner's online application for a character certificate is quashed, and the Superintendent of Police is directed to issue the certificate within two weeks.
Summary
The petitioner, Naveen Kumar, filed a writ petition seeking a certiorari order to quash the order of the Superintendent of Police (Respondent No.3) that dismissed his online application for a character certificate. The State argued that a Government Order dated 9 April 2026, issued in accordance with a prior judgment (Writ‑C No. 718 of 2025, Anil Kumar v. State of U.P.), mandated the issuance of such certificates. The Court examined whether the dismissal contravened the Government Order and the earlier precedent. Finding that the order was inconsistent with the GO and the binding judgment, the Court set aside the impugned order. It directed the Superintendent of Police to issue the character certificate within two weeks of receiving the petitioner's application and certified copy of the GO, and disposed of the writ petition.
Issues considered
- Whether the order dismissing the petitioner's online application for a character certificate is liable to be quashed.
- Whether the Government Order dated 9 April 2026, in line with the earlier judgment, is binding on the Superintendent of Police.
