Allahabad High Court
RIBHU DUBEYversusGAUTAM BUDDHA UNIVERSITY AND 3 OTHERS
- Decided
Holding
The court held that the writ petition is to be disposed of, granting liberty to pursue the internal appeal and directing the university to decide it expeditiously.
Summary
The petitioner, Ribhu Dubey, was expelled from Gautam Buddha University and filed a writ petition challenging the expulsion. The petitioner’s counsel argued that an alternative remedy exists in the form of an appeal before the university's Board of Management. The university’s counsel raised no objection to this approach. The court accepted that the alternative remedy is available and therefore disposed of the writ petition, granting the petitioner liberty to file the internal appeal within a week. The court further directed the university to decide the appeal within two weeks, adopting a sympathetic view.
