Allahabad High Court

KAMAL PANDEY AND ANOTHERversusSTATE OF UTTAR PRADESH AND 5 OTHERS

Decided

Holding

The High Court disposed of the writ petition, directing the appellate court to decide the pending stay applications expeditiously and to maintain the status‑quo, without examining the merits of the underlying dispute.

Summary

Petitioners Kamal Pandey and another filed a writ petition seeking to set aside an order dated 09‑04‑2026 passed by the appellate court in appeal No. D201916660000091 (now RST/1780/2025) and to compel the court to decide pending stay applications concerning possession of two land parcels in Sonbhadra. The petitioners argued that the appellate court wrongly rejected their stay applications on the ground that the opposite parties were ready to argue, contending that readiness to argue does not preclude interim relief. The High Court observed that the underlying appeal was still pending and that entertaining the writ on merits would be premature. Consequently, the Court disposed of the writ petition, directing the appellate court to decide the stay applications within three months, to maintain the status‑quo over the property, and to ensure proper notice and hearing. The Court also warned that any undue adjournments by the petitioners would result in automatic vacating of the interim protection.

Issues considered

  • Whether the appellate court erred in rejecting the petitioners' stay applications on the ground that the opposite parties were ready to argue the matter.
  • Whether the writ petition is maintainable when the substantive appeal and stay applications are still pending.
  • Whether the High Court should grant interim relief and maintain status‑quo pending determination of the stay applications.

3. Contention of learned counsel for the petitioner is that in appeal, petitioner
preferred certain stay applications of various dates. All such applications have been
rejected by the Appellate Court on the ground that opposite parties have appeared and
parties are ready to argue the matter, therefore, there is no reason to pass an interim
order. It has been further contended by learned counsel for the petitioner that such
view is wholly erroneous, application for interim relief ought not to have been rejected
on this ground that parties are ready to argue the matter.

4. Since the proceedings are pending, no useful purpose would be served in keeping
                                                                                                   WRIC No. 15428 of 2026
                                                                        2

                                    this writ petition pending.

                                    5. Accordingly, the writ petition stands disposed of with a direction to respondent

upon all the respondents and providing opportunity of hearing to all the
concerned parties as well as giving a reasonable opportunity of leading
evidence in respect of their case provided there is no other legal impediment.

                                    6. It is made clear that this Court has not examined the matter on merits. Till disposal
