Allahabad High Court

SANGAM LALversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Commissioner of Police must issue the character certificate within two weeks of receiving the certified copy of the Government Order.

Summary

The petitioner, Sangam Lal, applied online on 10 February 2026 for a character certificate, which required the Commissioner of Police to issue it despite a pending criminal case against him. The State, through its counsel, cited a Government Order dated 9 April 2026, issued pursuant to a Lucknow Bench judgment in Anil Kumar v. State of U.P. (Writ‑C No.718 of 2025). The Court examined whether the order obligates the police to grant the certificate notwithstanding the pending charge. Relying on the GO and the higher‑court precedent, the Court held that the Commissioner must issue the certificate within two weeks of receiving a certified copy of the order. Consequently, the writ petition was disposed, directing compliance with the GO.
