Allahabad High Court
VIKRAM AND 26 OTHERSversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
The Court held that the grievance of the petitioners shall be examined by the Chief Executive Officer, Noida within six weeks, thereby providing a remedy for the delay in licensing.
Summary
The petitioners, who are existing street vendors, applied for vending shop allotments under Section 3 of the Street Vending Act, 2014 in Work Circle 1‑10, but the Noida Development Authority failed to issue licenses or allotment letters despite completing surveys and selection. The petitioners filed a writ petition seeking relief. The respondents argued that the tribunal meant to handle such matters lacks a judicial officer, and therefore requested that the Chief Executive Officer (CEO) of Noida examine the grievance. The Court examined whether it could direct the administrative authority to act in the absence of a judicial officer. Relying on the need to ensure the petitioners’ statutory right to a license and the authority’s duty to act, the Court ordered that the CEO examine the grievance and hear the petitioners within six weeks, along with a fresh representation. The petition was consequently disposed.
Issues considered
- Whether the High Court can direct the Chief Executive Officer of Noida Development Authority to examine the petitioners' grievance in the absence of a judicial officer.
- Whether the petitioners are entitled to a license under Section 3 of the Street Vending Act, 2014 despite the authority’s inaction.
