Allahabad High Court

SANDEEP SINGHversusSTATE OF U.P. AND 12 OTHERS

Decided

Holding

The writ petition is not maintainable for execution of a revenue court order; therefore, it is dismissed.

Summary

The petitioner, Sandeep Singh, filed a writ petition seeking a mandamus directing the respondents to remove an obstacle obstructing his access to agricultural land, invoking Section 25 of the U.P. Revenue Code, 2026 and paragraph 460 of the U.P. Revenue Court Manual. He alleged that an order dated 16‑01‑2023 had not been implemented. The learned Standing Counsel raised a preliminary objection, relying on the Division Bench judgment in Manbhavati v. State of U.P. (2020 1 AWC 789A) and the earlier writ Brij Bhushan Rai v. State of U.P. (Writ C No. 7863 of 2018), contending that writ petitions are not maintainable for execution of revenue court orders. The court examined paragraph 460 of the Manual, which provides a specific execution procedure, and concluded that the writ jurisdiction was not appropriate. Consequently, the petition was dismissed, with the court directing the petitioner to pursue the remedy available under the Revenue Court Manual.

3. Contention of learned counsel for the petitioners is that an order dated

4. Learned Standing Counsel has raised a preliminary objection that in view
of the judgment of Division Bench of this Court in case of Manbhavati v.
State of U.P. and others reported in 2020 1 AWC 789A and Writ C No.
7863 of 2018 (Brij Bhushan Rai v. State of U.P. and 6 others) the writ
petition is not maintainable for execution of orders passed by Revenue

view of provisions of paragraph no. 460 of the U.P. Revenue Court Manual,
the petitioners have remedy for getting the order implemented. For ready
reference, paragraph no. 460 of the U.P. Revenue Court Manual, is quoted as
under:
