Allahabad High Court

TULSI DEVIversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court, on consent, disposed of the writ petition without adjudicating the merits and directed the petitioner to file a fresh representation within two weeks.

Summary

The petitioner, Tulsi Devi, filed a writ petition seeking that a claim/representation dated 12 January 2026 pending before the second respondent be decided within the stipulated period. The respondents, including the State of U.P., contended that if the representation remains pending, it would be considered and decided expeditiously. The court, after hearing counsel, noted that notice to the private respondent No. 3 was unnecessary. On the parties' consent and without expressing any view on the merits, the court disposed of the petition, directing the petitioner to file a fresh application before the second respondent within two weeks. The court further ordered that any such fresh application, if filed within the stipulated time, would be examined and remedied within six weeks, after affording an opportunity to all stakeholders, especially respondent No. 3.

                                    Court No. - 21
                                                      HON'BLE MAHESH CHANDRA TRIPATHI, J.
                                                      HON'BLE KUNAL RAVI SINGH, J.

                                         1. Heard learned counsel for the petitioner and Sri Ambrish Shukla,
learned Additional Chief Standing Counsel for the State-respondents.
                                         2. In view of the order, which is proposed to be passed, notice need not to
issued to the private respondent no. 3.
                                         3. In pith and substance, the grievance of the petitioner is that the
claim/representation dated 12.01.2026 pending before the second
respondent be decided within stipulated period.
                                         4. Learned Additional Chief Standing Counsel very fairly states that in
case any such representation is still pending and has not been disposed
of, the same will be considered and decided expeditiously.
                                         5. In view of the above, on consent and without expressing any opinion
on the merits of the issue and considering the facts and circumstances
of the case, this writ petition is disposed of finally asking the petitioner
to move a fresh application/representation before the second
respondent ventilating her grievance qua to her rights within two weeks
from today. In case, any such application/representation is preferred by
the petitioner within stipulated period definitely the same would be
looked into, examined and remedied strictly in accordance with law
within six weeks thereafter but certainly after affording opportunity to
all stakeholders specially respondent no. 3.

(Kunal Ravi Singh,J.) (Mahesh Chandra Tripathi,J.)
