Allahabad High Court

SITA RAM AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court directed the respondent to decide the pending restoration application within twelve weeks, thereby disposing of the writ petition.

Summary

The petitioners filed a writ petition seeking a mandamus directing Respondent No.2 to decide a restoration application filed on 27 November 2020, which had remained pending despite several dates being fixed. The petitioner argued that the delay was unjustified and requested an expeditious decision. The court examined the petition and noted that keeping the writ petition pending served no useful purpose. Without delving into the merits of the restoration application, the court ordered the respondent to decide the application within twelve weeks of the certified copy of the order, after service and hearing, and to avoid unnecessary adjournments. The petition was therefore disposed of with the directive for prompt adjudication.
