Allahabad High Court

SHIVAM KHARABANDAversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court quashed the rejection of the character certificate and directed the Deputy Commissioner of Police to issue the certificate within two weeks.

Summary

Shivam Kharabanda filed a writ petition seeking a certiorari to quash the Deputy Commissioner of Police’s rejection of his character certificate dated 05‑07‑2025. The State relied on a Government Order dated 9 April 2026, issued pursuant to a prior judgment of the Allahabad High Court in Writ‑C No. 718 of 2025 (Anil Kumar & Others v. State of U.P. & Others). The Court held that the rejection was unlawful and directed the Deputy Commissioner to issue the certificate within two weeks of receipt of the petitioner’s application and certified copy of the GO. Consequently, the impugned rejection was set aside. The writ petition was disposed of accordingly.

Issues considered

  • Whether the rejection of the petitioner’s character certificate should be quashed.
  • Whether the Government Order dated 9 April 2026, issued in line with the earlier judgment, mandates issuance of the certificate.
