Allahabad High Court
VINOD KUMAR AND 4 OTHERSversusSTATE OF UTTAR PRADESH AND 4 OTHERS
- Decided
Holding
The Court directed the District Magistrate to consider the petitioners' representation and pass an order within six weeks, thereby granting the relief sought.
Summary
The petitioners filed a writ petition seeking a mandamus directing the State of Uttar Pradesh, YEIDA, NHAI and the District Magistrate of Hathras to decide their representation dated 10‑12‑2025 for payment of compensation and interest for land acquired at Village Bichpuri. They claimed the land (Khasra/Gata no.‑67, 0.2165 ha) had not been compensated and requested expeditious disposal. The respondents did not object to the petitioners' request for speedy consideration. The Court, without examining the merits, and with the parties' consent, ordered the District Magistrate to consider the representation and pass an appropriate order within six weeks, after hearing all stakeholders. The petition was disposed with this direction.
Issues considered
- What is the appropriate relief, if any, that the High Court can grant to compel the District Magistrate to decide the petitioners' representation for compensation?
