RAMESH SINGHversusADDITIONAL COMMISSIONER GORAKHPUR AND 6 OTHERS

Decided

Holding

The Court directed the Commissioner to decide the pending revision within six months, effectively granting the writ of mandamus.

Summary

Petitioner Ramesh Singh filed a writ petition seeking a mandamus directing the Additional Commissioner, Gorakhpur, to decide Revision No. C 201905000001086, which had been pending despite several dates being fixed. The petitioner argued that the delay was unjustified and requested an expeditious decision. The Court observed that there was no useful purpose in keeping the petition pending and ordered the respondent to decide the revision within six months, after serving a certified copy of the order and providing a hearing, without unnecessary adjournments. The direction was issued in accordance with law, aiming to ensure timely disposal of the pending revision. Consequently, the petition was disposed of with the mandated direction.
