Allahabad High Court

PRAMOD KUMAR AND ANOTHERversusSTATE OF UP AND 6 OTHERS

Decided

Holding

The Court directed the respondent to decide the pending case expeditiously, preferably within six months, without expressing any view on the merits.

Summary

Petitioner Pramod Kumar filed a writ petition seeking a mandamus directing the second respondent, a court, to decide a pending case (No. T201909550604155) under Section 34 of the Uttar Pradesh Land Revenue Act, 2006, which has been delayed since 2019 despite multiple dates being fixed. The petitioner argued that the delay was unjustified and requested an expeditious decision. The High Court, after hearing counsel, noted that the petition served no useful purpose if left pending and chose not to opine on the merits of the underlying case. Instead, the Court disposed of the writ petition, directing the respondent to decide the pending case within six months of the order, after serving all parties and without unnecessary adjournments. The order was signed on May 6, 2026, by Justice Manish Kumar Nigam.
