Allahabad High Court

SANJEEV VISHWAKARMAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court issued a mandamus directing the respondent to decide the pending case within six months, subject to service and hearing, and to avoid unnecessary adjournments.

Summary

The petitioner, Sanjeev Vishwakarma, filed a writ petition seeking a direction in the nature of mandamus to compel Respondent No. 2, a revenue officer, to decide case No. 6235 of 2025 (Vishwakarma v. Vinda Devi) arising under Section 34 of the U.P. Revenue Act, 2006. The petitioner alleged that the case had been pending since 2025 despite several dates being fixed and that the delay violated the principle of expeditious justice. The Court examined the petition and found that no useful purpose would be served by keeping the writ petition pending. Accordingly, it ordered Respondent No. 2 to decide the pending revenue case within six months of the certified copy of the order, after service on all parties and a hearing, and to refrain from unnecessary adjournments. The petition was finally disposed of with the direction to the respondent.
