Allahabad High Court

SANJU DEVIversusPREM SHANKAR SHUKLA AND 7 OTHERS

Decided

Holding

The High Court directed the Motor Accident Claim Tribunal (South), Prayagraj to decide the pending claim petition expeditiously, preferably within one year.

Summary

Petitioner Sanju Devi filed a writ petition seeking a court order directing the Motor Accident Claim Tribunal (South), Prayagraj to decide her pending Claim Petition No. 683 of 2018 against Prem Shankar Shukla within a fixed period. The petitioner argued that the claim had been unduly delayed and requested an expeditious decision. The court observed that keeping the writ petition pending served no useful purpose while the claim itself remained unresolved. Consequently, the court disposed of the writ petition and issued a direction to the tribunal to decide the claim within one year, without unnecessary adjournments, subject to any legal impediment. The order was signed on May 6, 2026.
