Allahabad High Court

SMT. RAJRANI DEVIversusMOTOR ACCIDENT CLAIMS TRIBUNAL (NORTH) AND ANOTHER

Decided

Holding

The writ petition is disposed of, with a direction to the Motor Accident Claims Tribunal (North), Prayagraj to decide the pending application expeditiously, without unnecessary adjournments.

Summary

Petitioner Smt. Rajrani Devi filed a writ petition seeking a court direction for the Motor Accident Claims Tribunal (North), Prayagraj to decide her pending application dated 13 September 2025 (Misc. Case No. 164 of 2025) within a fixed time and to release the remaining 40% amount of Rs.5,94,000. The petitioner argued that the matter required expeditious resolution. The Court observed that the underlying application was already pending before the Tribunal and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition, directing the Tribunal to decide the pending application promptly, without unnecessary adjournments, subject to any legal impediment. No further relief was granted beyond the direction to the Tribunal.

Issues considered

  • What direction, if any, should the High Court give to the Motor Accident Claims Tribunal to ensure expeditious disposal of the pending application?
  • Whether the writ petition should be dismissed on the ground that the underlying application is already pending before the Tribunal.
