Allahabad High Court

SHOBHA SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court ordered the Board of Revenue to decide the pending revision within six months, without prejudice to its independent consideration of the revision's maintainability.

Summary

The petitioner, Shobha Singh, filed a writ petition seeking an order directing the Board of Revenue to expedite the disposal of Revision No. REV/3272/2025, which was pending before it. The State respondents argued that the revision itself was not maintainable, but the court held that the issue of maintainability need not be decided at this stage because the petition only sought speedy disposal. Accordingly, the court directed the Board of Revenue (respondent No. 2) to consider and decide the pending revision within six months of receiving a certified copy of the order, without being influenced by the order regarding maintainability. The court clarified that the Board could still examine the maintainability of the revision independently. The writ petition was thereafter disposed of.

Issues considered

  • What is the appropriate judicial remedy when a party seeks only an expeditious disposal of a pending revision before the Board of Revenue?
  • Whether the court should adjudicate the maintainability of the revision at the stage of a writ petition limited to expediting disposal.

Court No. - 2
                     HON'BLE VIVEK SARAN, J.

1. Heard Sri Amit Pratap Singh, learned counsel for the petitioner and
learned Standing Counsel for the State respondents.

2. The sole prayer made in the instant writ petition is for expediting
disposal of Revision No. REV/3272/2025 [Computerized Case No.
AL20250544003272] (Shobha Singh vs. SDM Tamkuhi and others),
which is stated to be pending before the Board of Revenue.

3. Learned Standing Counsel representing the State respondents submits
that such a revision is not maintainable and therefore the relief so prayed
for in the writ petition may not be granted.

4. Be that as it may, since the petitioner has prayed solely for expeditious
disposal of the revision, therefore, the issue of maintainability of the
revision itself is not to be adjudicated by this Court at this stage.

5. In view of the prayer so made in the writ petition, no useful purpose
would be served by keeping the writ petition pending and therefore,
respondent no. 2 is requested to consider and decide Revision No.
REV/3272/2025 [Computerized Case No. AL20250544003272] (Shobha
Singh vs. SDM Tamkuhi and others), stated to be pending before it,
within a period of six months from the date of production of a certified
copy of this order before it.

6. It is however made clear that it respondent no. 2 shall not be influenced
by the instant order while considering the question of maintainability of
