Allahabad High Court

SMT NAIMA AND 2 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The High Court directed the Motor Accident Claim Tribunal, Ghaziabad, to decide the pending case within one year, thereby disposing of the writ petition.

Summary

Petitioners Smt. Naima and two others filed a writ petition seeking a direction to the Motor Accident Claim Tribunal (MACT), Ghaziabad, to decide a pending case (MACT No. 19 of 2025) concerning them and the respondents under Sections 140 and 166 of the Motor Vehicle Act. The petition alleged that the Tribunal had unduly delayed the adjudication and requested the High Court to order an expeditious disposal. The Court observed that the sole relief sought was a directive to the Tribunal and that keeping the writ petition pending served no useful purpose while the underlying case remained unresolved. Consequently, the Court disposed of the writ petition, directing the MACT to decide the pending matter within one year of receiving the certified copy of the order, without unnecessary adjournments. The order was issued without issuing notices to the respondents.
