Allahabad High Court
SOURYA ESTATES PRIVATE LIMITED COMPANYversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
Compensation shall be released in favour of the petitioner if the detailed application before the Additional District Magistrate is processed within three months and no impediment is found.
Summary
Sourya Estates Private Limited, a company registered under the Companies Act, 1956, owned one‑third shares in two plots that were acquired by the government and an award for compensation was made on 30‑12‑2023. The company filed a writ petition seeking the disbursement of the awarded compensation, alleging that the Additional District Magistrate (Land Acquisition), Ghaziabad had not processed its applications. The State counsel argued that the grievance should be examined by the Additional District Magistrate in accordance with law, while the Ghaziabad Development Authority (GDA) contended that it was the competent authority and that compensation had already been deposited with the Special Land Acquisition Officer. The Court, without inviting further objections, directed the petitioner to file a detailed application before the Additional District Magistrate and ordered that the application be decided within three months, with compensation released if no impediment existed. The writ petition was consequently disposed of.
Issues considered
- Whether the petitioner is entitled to the compensation awarded in the land acquisition award.
- Whether the Additional District Magistrate (Land Acquisition), Ghaziabad has jurisdiction to process the petitioner’s grievance.
