Allahabad High Court

SUDHIR KUMARversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court directed the Additional District Magistrate to decide the pending recall application within twelve weeks, thereby granting the writ of mandamus.

Summary

Sudhir Kumar filed a writ petition under Article 226 seeking a mandamus directing the Additional District Magistrate, Meerut, to decide a recall application dated 22 September 2025. The petitioner argued that the application had been pending since 2025 despite several dates being fixed. The Court, after hearing counsel, noted that the petition served no useful purpose if left pending. Without addressing the merits of the recall application, the Court ordered the respondent to consider and decide the application expeditiously, within twelve weeks of the certified copy of the order, ensuring service and hearing, and to avoid unnecessary adjournments. The petition was consequently disposed of with the said direction.
