Allahabad High Court

VISHNU DATT TIWARIversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The High Court ordered the respondent to decide the pending land revenue case within three months, thereby granting the writ of mandamus.

Summary

Vishnu Datt Tiwari filed a writ petition before the Allahabad High Court seeking a mandamus directing the Additional District Magistrate of Prayagraj to decide a land revenue case (Case No. RST/6928 of 2021) that had been pending since 2021 under section 30 of the U.P. Land Revenue Code‑2006. The petitioner argued that despite several dates being fixed, the case remained undecided and urged the court to order an expeditious decision. The court observed that keeping the writ petition pending served no useful purpose and, without commenting on the merits of the underlying dispute, directed the respondent to decide the case within three months of the order, ensuring service on all parties and prohibiting unnecessary adjournments unless a legal impediment exists. The order thus aimed to enforce timely adjudication of the pending land revenue matter. The petition was consequently disposed of with the mandated direction.
