The High Court held that the writ petition was not the proper forum for seeking interim relief and therefore dismissed it.
Summary
The petitioner, Dinesh Chandra, filed a writ petition seeking a certiorari to quash an order dated 17‑04‑2026 passed by the Additional District Judge, F.T.C‑I, Hathras, and a mandamus to stay the proceedings in L.A. No.1/2016 pending before that judge until the disposal of First Appeal No.1163/2025 before the High Court. The impugned order had directed the petitioner to appear for a hearing on 01‑05‑2026 and warned of dismissal for non‑compliance. The respondent counsel highlighted that the first appeal was already pending and listed for fresh hearing on 16‑07‑2026. The Court observed that the petitioner was already seeking interim relief in the pending appeal and that the writ petition was an inappropriate vehicle for such relief. Consequently, the Court dismissed the writ petition as it was deemed unnecessary and without merit.
Issues considered
- What is the appropriate remedy for a party seeking interim relief in a pending appeal – a writ petition or an application in the appellate proceeding?
- Whether the order dated 17‑04‑2026 passed by the Additional District Judge can be quashed by a writ of certiorari?
- Whether the High Court can issue a mandamus to stay the proceedings of L.A. No.1/2016 pending the outcome of the first appeal?
