Allahabad High Court

SHIV SAGAR SINGH SINGH AND 4 OTHERSversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The High Court directed the Chief Revenue Officer to decide the suit within six months, thereby granting the petition for expeditious disposal.

Summary

The petitioners filed a writ petition under Article 226 of the Constitution seeking the High Court’s intervention to ensure the speedy disposal of a civil suit (Suit No.D202102030006842) pending before the district court. The petition alleged that the suit was being unduly delayed and requested the Court to direct the respondent, the Chief Revenue Officer of Prayagraj, to decide the suit within a stipulated period. The standing counsel produced written instructions from the Chief Revenue Officer, which were taken on record. The respondent’s counsel raised no objection to the prayer for expeditious disposal. Consequently, the Court ordered that the respondent decide the suit within six months of the certified copy of the order, provided there is no legal impediment, and disposed of the writ petition.
