Allahabad High Court

SMT. NIDHI YADAV AND ANOTHERversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

Adult, consenting parties have a constitutional right to cohabit as husband and wife, and the court may grant a permanent injunction restraining any interference.

Summary

Smt. Nidhi Yadav and another filed a writ petition seeking a permanent order restraining the State of U.P. and other respondents from interfering in their marital life and directing authorities to provide them protection. The petitioners, both adults, submitted their school certificates and marriage registration to demonstrate consensual marriage and alleged threats from family members. The court examined whether adult, consenting individuals have a right to cohabit without external interference and whether a protective injunction could be issued under its writ jurisdiction. Relying on Supreme Court precedents such as Gian Devi, Lata Singh, Bhagwan Dass and Deepika, the court held that no one, including parents or the state, may impede the lawful domestic relationship of adults. Consequently, the court accepted the petition, ordered the respondents not to disturb the petitioners' peaceful marital life and directed immediate security measures, while expressly stating that it did not pass any judgment on the validity of the marriage.

Issues considered

  • Whether adult, consenting individuals have a fundamental right to live together as husband and wife without interference from family or the state.
  • Whether the court can issue a permanent injunction and protective order under its writ jurisdiction to prevent such interference.
  • Whether notice to the private respondents is required before granting the injunction.

  • right to cohabit
  • adult consent
  • protective order

Gian Devi v. The Superintendent, Nari Niketan,
                                                                                                     WRIC No. 21920 of 2026
                                                                          2

Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris no
fetters can be placed upon her choice of the person with whom she is to
stay, nor can any restriction be imposed regarding the place where she
should stay. The court or the relatives of the petitioner can also not
substitute their opinion or preference for that of the petitioner in such a
                                    matter."

                                                                                          (Dr. Gautam Chowdhary,J.)
