Allahabad High Court
SMT. RUCHI GOYALversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The court held that the Additional District Magistrate (Nazul), Agra must render a final decision on the petitioner’s request for a No Objection Certificate within six weeks, and if he is not the competent authority, must refer the matter to the appropriate authority.
Summary
The petitioner, Smt. Ruchi Goyal, filed a writ petition seeking a mandamus directing the District Magistrate and Additional District Magistrate (Nazul) of Agra to issue a No Objection Certificate (NOC) for the sanctioning of a map for a proposed layout plan. The petitioner relied on letters from the Agra Development Authority dated 19‑10‑2021 and 24‑5‑2022, which indicated that the Nazul department had not yet granted or refused the NOC. The respondents argued that the matter was pending before the Nazul department. The High Court, without examining the merits, ordered the Additional District Magistrate (Nazul) to take a final decision on the NOC request within six weeks of the certified copy of the order, and if he is not the competent authority, to refer the matter to the appropriate authority. The order was signed by Judges Prakash Padia and Vivek Saran on 29‑September‑2026.
Issues considered
- Whether the District Magistrate/Additional District Magistrate (Nazul) is obligated to issue a No Objection Certificate for the map sanction in the present case.

no. 2 and 3 to issue No Objection Certificate regarding
sanctioning of map for proposed Layout Plan of G.L. Town to

by the Agra Development Authority, Agra in its letter dated

3. It is argued that in spite of letter dated 19.10.2021 written by the Agra
Development Authority, Agra to the various District/Revenue Authorities
(Annexure No.4 to the writ petition), till date no No Objection Certificate
has been granted by the Nazul department. Learned counsel for the
petitioner has also placed reliance upon a letter dated 24.5.2022 written
by Prabhari Pravartan, Agra Development Authority, Agra in which again
a prayer has been made to grant No Objection Certificate in respect of the
land in dispute for which sanction of map was required but till date no
decision has been taken by the Nazul department either for the grant or
refusal of the No Objection Certificate in favour of the petitioner.
