Allahabad High Court
SMT. POOJA GAUTAM AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS
- Decided
- Bench
- GAUTAM CHOWDHARY
Holding
The petitioners are at liberty to live together and no person shall be permitted to interfere in their peaceful living; the police must provide immediate protection upon request.
Summary
The petitioners, both adults of different faiths, married under Section 5 of the Special Marriage Act and live together, but face threats and harassment from family members. They filed a writ petition seeking a mandamus directing the respondents not to interfere with their peaceful life and to provide police protection. The Court noted that a similar matter (Noori v. State of U.P.) had been decided, granting protection to inter‑faith couples. It held that the petitioners are free to live together and any disturbance should be reported to the Senior Superintendent of Police, who must provide immediate protection. The order does not adjudicate the validity of the marriage and leaves open the possibility of recall if documents are found forged. Consequently, the petition was disposed without costs.
Issues considered
- Whether the petitioners, married under the Special Marriage Act, are entitled to protection from interference by family members.
- Whether the Court can issue a writ of mandamus directing non‑interference and police protection.
