Allahabad High Court

ASHUTOSH SHARMAversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The writ petition is dismissed as not pressed.

Summary

The petitioners, Ashutosh Sharma, filed a writ petition before the Allahabad High Court challenging an action of the State of Uttar Pradesh and the Agra Development Authority. The respondents submitted instructions and the petitioner's counsel, Vijay Tripathi, argued that the petition should be dismissed as it was not pressed, and that the petitioner could file a fresh writ petition. The State’s Additional Chief Standing Counsel and the Agra Development Authority’s counsel did not oppose this view. The Court, after considering the submissions, held that the petition was indeed not pressed and dismissed it, granting the petitioner liberty to file a fresh petition. No substantive merits of the underlying dispute were addressed.
