Allahabad High Court

RINKI AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is dismissed because the petitioners are not entitled to the relief sought as the alleged prior marriage has not been legally dissolved.

Summary

The petitioners, Rinki and another, filed a writ petition seeking a permanent injunction directing the respondents not to interfere with their live-in relationship and to provide them protection. They asserted that both are adults, have voluntarily cohabited, and face threats from family members, claiming a serious risk to their lives. The respondents, through the State and the C.S.C., contended that one petitioner (Yachi No.1) is still legally married to another person and that no valid divorce has been obtained, rendering the petition untenable. The court examined the documents and found that the alleged prior marriage has not been dissolved in accordance with law, and therefore the petitioners lack legal standing for the relief claimed. Consequently, the court dismissed the petition without further comment.

Issues considered

  • Whether a live-in relationship between two consenting adults can be protected by a permanent injunction under Indian law.
  • Whether the petitioners are entitled to protection when one of them is allegedly still married and no legal divorce exists.
  • Whether the writ petition is maintainable in view of the alleged existing marriage and lack of legal dissolution.

Subjects

  • live-in relationship
  • permanent injunction
  • protection order
  • marriage dissolution

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                                         WRIC No. 28101 of 2026
                                                                           2

                                                                                              (Dr. Gautam Chowdhary,J.)
