- Decided

- CHANDRA KUMAR RAI
Holding
The petition is dismissed as the relief sought had already been adjudicated in another writ petition.
Summary
The petitioner Jiyalal filed a writ petition seeking a mandamus order to set aside a notice (R.C. No. 22 dated 29.04.2022) and to prevent interference in his peaceful possession of a plot of land (Arazi no. 596) in Kasaujha, Prayagraj. The petition alleged that the respondents, including the State of Uttar Pradesh and local authorities, were interfering with his possession and revenue records. The Court observed that the same relief had already been claimed and decided in another writ petition (Writ C No. 34456 of 2026) disposed on 9 September 2026. Consequently, the Court held that the present petition could not be entertained as the relief was already adjudicated. No further interference was deemed necessary, and the petition was dismissed.
Issues considered
- The Court considered whether a writ petition seeking mandamus can be entertained when the same relief has already been claimed and decided in a separate petition.
