Allahabad High Court

PRAMODversusUNION OF INDIA AND ANOTHER

Decided

Holding

The petition is disposed, directing the petitioner to follow the procedural guidelines of the cited precedents before the passport application can be decided.

Summary

The petitioner, Pramod, filed a writ petition under Article 226 seeking the disposal of his pending fresh passport application. The respondents, Union of India, informed the Court that a show‑cause notice had been issued to the petitioner in connection with a criminal case (case crime no. 64A of 2000) involving offences under Sections 147, 323, 504 and 506 of the Indian Penal Code. The Court observed that the petitioner must first comply with the procedural guidelines laid down in the earlier judgments of Rahimuddin v. Union of India and Wajiruddin Khan v. Union of India. After complying with those guidelines, the Regional Passport Officer is to decide the passport application in accordance with the timelines prescribed in those cases. Accordingly, the Court directed the petitioner to follow the said procedures and disposed of the petition.
