Allahabad High Court

SMT. PAYAL AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that a permanent injunction cannot be issued as it would be contrary to law, and dismissed the petition.

Summary

Petitioners Payal and another filed a writ petition seeking a permanent injunction restraining the State of Uttar Pradesh and three others from interfering in their marital life and directing authorities to provide them protection. The respondents argued that the petitioners are in a live‑in relationship with a man who is already married and that the petitioner has not obtained a divorce, making any protective order illegal under the Indian Penal Code. The court noted that a permanent injunction cannot be issued to contravene statutory provisions, especially when the relationship involves a potential offence under IPC sections 494 and 495. Citing the earlier judgment in Asha Devi v. State of U.P., the court held that no protection can be granted in such circumstances. Consequently, the petition was dismissed for lack of merit.

Issues considered

  • Whether a permanent injunction can be granted to protect a live‑in relationship where one party is already married
  • Whether granting such an injunction would violate provisions of the Indian Penal Code, particularly sections 494 and 495

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                     (Dr. Gautam Chowdhary,J.)
