Allahabad High Court

AMIT KUMAR SINGH @ SONU SINGHversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The appellate order cancelling the petitioner’s arms licence is set aside and the matter is remitted to the Appellate Authority for a fresh order, taking into account the earlier High Court judgment and allowing amendment of the appeal.

Summary

The petitioner, an advocate, held three arms licences; two were previously cancelled but restored by this Court in Writ Petition No.24565/2023. The remaining licence, issued by the District of Kushinagar, was cancelled by the District Magistrate on the ground of a pending criminal case (Crime No.193/22). The petitioner filed a belated reply and appealed to the Commissioner, whose order upholding the cancellation was dismissed. The High Court observed procedural deficiencies, the petitioner’s failure to disclose relevant documents, and the lack of material to prove malafide intent. It held that the earlier judgment restoring licences precludes cancellation on the basis of a single pending case and set aside the appellate order, remitting the matter for fresh consideration with liberty to amend the appeal and disclose whether the surrendered licence was returned.

Issues considered

  • Whether the pendency of a single criminal case justifies cancellation of an arms licence under Section 17 of the Arms Act.
  • Whether a prior High Court order restoring arms licences binds a licensing authority in subsequent cancellation proceedings.
  • Whether procedural defaults, such as delayed reply and non‑disclosure of documents, affect the validity of the cancellation order.
  • Whether allegations of malafide can be entertained without material before the licensing authority.

10. It would be relevant to observe here that neither in
the reply filed on 4.7.2025 and nor during hearing before
District Magistrate, proceedings initiated in regard to
cancellation of two arms licence were disclosed and even
reference order dated 26.11.2024, which was relevant for
the purpose was also not placed on records of
proceedings.

11. The petitioner thereafter filed an appeal before the
Commissioner Gorakhpur Division Gorakhpur on
19.12.2025 and from perusal of it is evident that
surprisingly therein also, petitioner has not disclosed
about outcome of above referred proceedings. So far as
other two arms license are concerned, the main argument
of counsel for petitioner before this Court was that once
two arms license were restored on basis of a judgment
passed by this Court, that mere pendency of a single
criminal case would not be a sufficient ground to cancel
the arms license. Same are legally be followed in present
case also. For reference memo of appeal is reproduced
hereinafter, that no such ground was taken therein.

13. Sri Omar Zamin, learned counsel for the petitioner
vehemently argued that proceedings initiated against the
petitioner under the Arms Act for cancellation of arms
licence was in pursuance of direction of Senior Police
officials of State of U.P. who are made party by name also
and reference was made to some of the paragraphs of
writ petition to show that there was a malafide on their
behalf and some of the documents were also referred.

14. Learned counsel for the petitioner also submitted that
once this Court has taken a view that on basis of one
criminal case presently pending against the petitioner,
arms license cannot be cancelled and contrary view
cannot be taken by other Licensing Authority. However,
learned counsel for the petitioner is not able to show that
whether the order passed by this Court as referred above
was placed before District Magistrate or before the
concern Commissioner at District-Kushinagar even in
argument before it.

15. Per Contra, Sri P. Tripathi, learned Standing Counsel
has supported the impugned order and submitted that
once the petitioner has not produced relevant documents
before the said authority, there was no illegality in the
impugned order. Petitioner has not denied that he was not
involved in two criminal cases where acquittal was
granted after trial and one criminal case is pending
against him.

there of is not even annexed.

18. The reply filed before Licensing Authority, Kushinagar
and the memo of appeal filed before concern
Commissioner were subsequent to the order passed by
this Court, still reference to earlier proceedings was not
disclosed.

19. The petitioner, an active Advocate was pursuing his
case. Still, in entire writ petition it has not been disclosed
that why relevant documents were not placed before
concern authorities as well as it is also not disclosed that
whether one of the arms license issued from District
Siddharth Nagar was surrendered by the petitioner or not
and these shortcomings are facing adversly against the
petitioner.

20. The petitioner instead of taking specific averments
and grounds in this writ petition which could support his
case probably has given more attention to alleged
malafide against the Senior Police Officials of State of
Uttar Pradesh, however, such allegations will not cover up
the pleadings not only before this Court but before the
authority concerned also. Even the memo of appeal filed
before the Appellate Authority was poorly drafted.

                                         WRIC No. - 30621 of 2026

21. In order to deal with allegations of malafide, Court has
to issue notice to the parties made by name, however,
Court finds that it would not help the case of the
petitioner since not only the petitioner has failed to file
reply to the notice after 4 years, but has not placed his
case effectively before the Licensing Authority as well as
before Appellate Authority, by showing orders passed in
his favour i.e. an order passed by this court.

22. Case of malafide would be considered only when
there is material before the concern Authority that the
action was malafide, therefore, Court finds that impugned
order being based on material available and order passed
by this Court which was not placed before Licensing
Authority, therefore, impugned order cannot be interfered
on such grounds.

23. Even observing above, this Court still considers that
once this Court has passed an order, wherein cancellation
of arms license due to pendency of criminal case was
interfered with and probably was acted upon also and
since other two arms license issued to the petitioner was
restored, therefore, in case said material is not permitted
to be placed before Appellate Authority it would be
contrary to the orders passed by this Court therefore,
order passed by the Appellate Authority dated 23.5.2026
is set-aside and matter is remitted to Appellate Authority
to pass a fresh order and petitioner will be at liberty to
amend the memo of appeal and place the orders passed
by this Court in regard to other two arms license.
                                                                    11
                                                                                 WRIC No. - 30621 of 2026

                            24. Petitioner will also disclose whether he has
surrendered one of the arms license restored earlier at
District-Kushi Nagar and while considering the appeal
afresh judgment passed by this Court in Ram Milan Vs.
State of U.P. & Ors, Neutral Citation
No.2021:AHC:119661 shall also be taken note of and
appeal be decided expeditiously, preferably within a
                            period of six months .

                            25. A word of caution is necessary to mention here that
being an active Advocate, petitioner may remain cautious
and more responsible before filling writ petition.

                            26. With aforesaid observations, liberty and directions,
this writ petition is disposed of.

                                                             (Saurabh Shyam Shamshery,J.)
