USHAversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court directed the University to consider the petition afresh and pass a reasoned order within two weeks after the petitioner complies with the required documentation.

Summary

The petitioner, Usha, filed a writ petition seeking a direction for the University to issue his computerized mark sheet and degree for the B.Ed. course of 2012-13 after having passed the examination. Although the university initially generated a mark sheet on its portal, it refused to issue the documents citing the absence of an enrollment number. After the petitioner obtained an enrollment number and a migration certificate through a letter from respondent No.5, the university still failed to issue the mark sheet. The petitioner approached the High Court, alleging inaction and seeking relief. The Court disposed of the petition, granting the petitioner liberty to comply with the university's requirements and directing the university to consider the matter afresh and pass a reasoned order within two weeks of receiving the necessary documents.

Thereafter, the petitioner participated in the selection process for the post of
Trained Graduate Teacher (TGT), in which he was selected. The petitioner
thereafter approached the office of the respondent-University for issuance of
the computerized mark sheet and degree. However, the respondent-
University declined to issue the said documents on the oral objection that no
enrollment number had been generated for the petitioner.

4. The petitioner thereafter approached respondent no. 5, who communicated
the matter vide letter dated 01.07.2026 to the concerned examination centre
where the petitioner had appeared in the annual examination. Pursuant
thereto, a report was submitted to the University. In response to the letter
dated 01.07.2026, the respondent-University allotted an enrollment number

                                                                     2

and degree been issued to him. Aggrieved by the inaction on the part of the
respondent-University, the petitioner has been constrained to prefer the

furnished to learned counsel for the petitioner.

                                    7. In view of the aforesaid, the present petition is disposed of with liberty to
the petitioner to comply with the requirements of the University. Upon such
compliance, the University shall consider the matter afresh and pass a
reasoned and speaking order, duly taking into consideration and recording
the contentions raised by the petitioner.

                                    8. It is further directed that the aforesaid order shall be passed within a
