Allahabad High Court

CHHANGUR RAIversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that mandamus may be issued directing the Tehsildar to decide the pending mutation suit within four months.

Summary

The petitioner, Chhangur Rai, filed a mutation suit (Case No. 12740 of 2026) under Section 34 of the U.P. Revenue Code, 2006, which has been pending before the Tehsildar (Respondent No‑2) since 4 May 2026. He sought a writ of mandamus directing the Tehsildar to decide the case within a stipulated period. The State’s standing counsel raised no objection to the relief sought. The High Court examined whether the court could compel the revenue officer to dispose of the pending mutation case expeditiously. It held that mandamus was appropriate to ensure timely adjudication. Consequently, the Court ordered the Tehsildar to decide the pending mutation case within four months of the certified copy of the order, and disposed of the petition accordingly.

Issues considered

  • Whether a writ of mandamus can be issued directing the Tehsildar to decide a pending mutation suit within a specified time
  • Whether the delay in deciding the mutation case violates the statutory duty under Section 34 of the U.P. Revenue Code, 2006
