Allahabad High Court
ARVIND SWAROOP AND ANOTHERversusSTATE OF U.P. AND 6 OTHERS
- Decided
Holding
The petitioners may re‑apply for caste certificates after the pending appeal concerning their entry in the parivaar register is decided.
Summary
Petitioners Arvind Swaroop and another challenged the rejection of their applications for caste certificates by the State of Uttar Pradesh. The rejection orders, dated 24 October 2024 and 14 March 2026, cited the absence of a latest copy of the "parivaar register" as the reason. Petitioners argued that the entry of their names in the register is itself the subject of a pending appeal, making the rejection premature. The Court examined whether the rejection could stand while the appeal concerning the register was unresolved. It held that the petitioners could file fresh applications for caste certificates once the pending revision/appeal regarding the parivaar register is disposed of. Accordingly, the writ petition was disposed.
