Allahabad High Court

ARVIND SWAROOP AND ANOTHERversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The Court held that the petitioners may re‑apply for the domicile certificate after the pending appeal on the parivaar register is disposed.

Summary

Petitioners Arvind Swaroop and another applied for a domicile certificate, which was rejected on 14 March 2026 because they had not attached a copy of the parivaar register. They had applied to be included in the register and were awaiting the outcome of that appeal. The State argued that a current copy of the register showing the applicant’s name is mandatory for issuing the certificate. The Court directed that the petitioners may file a fresh application for the domicile certificate after the pending appeal regarding the parivaar register is decided. Accordingly, the writ petition was disposed.

Issues considered

  • Whether the rejection of the domicile certificate application for lack of a parivaar register copy is legally valid
  • Whether the petitioners can re‑apply for the certificate pending the outcome of the appeal concerning the register
