Adult petitioners are free to live together and no person may lawfully interfere with their marital life, warranting a protective injunction and a directive to register the marriage within two months.
Summary
The petitioners, Smt. Varsha Rajpoot and another adult, filed a writ petition seeking a permanent injunction restraining the respondents, including family members, from interfering in their marital life and directing the police to provide them protection. They submitted school certificates and a pending application for marriage registration, alleging threats and intimidation from private respondents. The court examined Supreme Court precedents affirming that adults have the right to choose their spouse and live together without parental or familial interference. Relying on cases such as Gian Devi, Lata Singh, and Seema v. Ashwani Kumar, the court held that no restriction could be placed on the petitioners' choice of partner. Accordingly, the court ordered that the respondents refrain from any interference, directed the police to ensure the petitioners' safety, and mandated that the marriage be registered within two months, after which the protection order would lapse.
Issues considered
- Whether an adult's right to marry and cohabit can be protected by a permanent injunction against family interference
- Whether the court can direct police protection for the petitioners
- Whether the petitioners must register their marriage within a specified period as a condition of protection

HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari
Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P.
and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
(supra) has held as under:
"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."
(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani
