Allahabad High Court

ANURAG SAXENA AND ANOTHERversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The court held that adult individuals have the right to live together without interference and therefore may issue a protection order directing the police to safeguard the petitioners and ordering them to register their marriage within two months.

Summary

Anurag Saxena and another filed a writ petition seeking a permanent injunction restraining the respondents from interfering in their marital life and requesting police protection, alleging threats from family members. The petitioners submitted proof of age and a pending application for marriage registration, asserting that they are adults and have married of their own free will. The court, relying on Supreme Court precedents, held that adults have the right to cohabit without parental or third‑party interference and therefore can be granted protection. It directed the senior police officer to provide immediate security to the petitioners and ordered the petitioners to complete their marriage registration within two months, after which the protection would lapse. The court clarified that it is not passing any judgment on the validity of the marriage itself and disposed of the writ petition with the above directions.

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                           2

Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
