Allahabad High Court

NITIN SAHARIYAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that the order dated 13 May 2026 was not illegal, perverse or infirm and therefore the writ petition was dismissed.

Summary

The petitioner, Nitin Sahariya, filed a writ petition challenging an order dated 13 May 2026 issued by the Additional Secretary of the Secondary Education Board, Regional Office, Meerut, which refused to correct his date of birth in school records. The petitioner claimed that his date of birth was incorrectly recorded as 25-07-2005 instead of the correct 25-07-2007. The respondents produced instructions showing that the scholar register contained overwriting of the date of birth entry, raising doubts about the record's authenticity. The High Court examined the impugned order and the verification report and found no illegality, perversity, or infirmity in the authority's decision to decline the correction. Consequently, the Court held that there was no ground for interference with the order. The writ petition was dismissed as being devoid of merit.

                                    Counsel for Respondent(s) : C.S.C.

                                    Court No. - 38
                                                         HON'BLE VINOD DIWAKAR, J.

                                    1. Heard learned counsel for the petitioner and Shri Vaibhav Tripathi,
learned Standing Counsel for the State-respondents.

                                    2. The present writ petition has been filed seeking to quash and set aside the
impugned order dated 13.05.2026 passed by the Additional Secretary,
Secondary Education Board, Regional Office, Meerut, whereby the
petitioner's request for correction of date of birth in the school records has
                                    been declined.

                                    3. Learned counsel for the petitioner submits that the petitioner's date of
birth has been wrongly recorded as 25.07.2005, whereas the petitioner's
correct date of birth is 25.07.2007.

                                    4. In compliance with the order dated 14.08.2026, learned Standing Counsel
has produced the instructions. As per the instructions, upon verification of
the scholar register, it has been found that there exists overwriting in the
entry recording the petitioner's date of birth, which raises a serious doubt as
to the genuineness and sanctity of the said record.

                                    5. Having heard learned counsel for the parties and upon perusal of the
impugned order as well as the instructions produced before this Court, it
emerges that the authority concerned, upon due verification, found
overwriting in the scholar register with respect to the entry of the petitioner's
date of birth. This Court does not find any illegality, perversity, or infirmity
in the impugned order dated 13.05.2026 warranting interference.

                                    6. The writ petition, being devoid of merit, is accordingly dismissed.
