M/S KANODIA CEMENTS LTD. THRU DIRECTORversusU.P.P.C.L. THRU ITS CHAIRMAN AND 3 OTHERS

Decided

Holding

The writ petition is dismissed for want of prosecution.

Summary

M/s Kanodia Cements Ltd., through its director, filed a writ petition before the Allahabad High Court against U.P.P.C.L. and its chairman and three others. The court issued a notice to the petitioner, but no vakalatnama was filed and no representative appeared. The petitioner failed to prosecute the petition, apparently losing interest over time. Consequently, the court held that the service of notice was sufficient and dismissed the writ petition for want of prosecution. The interim order, if any, was vacated.

                                                                       Mishra

                                    Court No. - 40
                                                     HON'BLE SARAL SRIVASTAVA, J.
                                                     HON'BLE SUDHANSHU CHAUHAN, J.

As per office report dated 09.12.2025, the notice has been served upon the
petitioner, but neither any vakalatnama nor anyone has put in appearance on
behalf of the petitioner. Therefore, service of notice upon petitioner is
                                    deemed sufficient.

It appears that by the efflux of time, the petitioner has lost interest in
                                    pursuing the case.

Accordingly, the writ petition is dismissed for want of prosecution.

Interim order, if any, stands vacated.
