Allahabad High Court

SHAKEEL AHMADversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court directed the Additional Commissioner (Administration), Azamgarh Division, to decide the pending appeal within four months, thereby granting the writ of mandamus.

Summary

The petitioner filed a writ petition seeking a mandamus directing the Additional Commissioner (Administration) of Azamgarh Division to decide an appeal filed under Section 24(4) of the U.P. Revenue Code, 2006, which had been pending since September 4, 2025. The petitioner argued that the delay violated the statutory time limits for deciding such appeals. The State, through its standing counsel, raised no objection to the petition being disposed with a direction to the respondent to decide the appeal. The Court, after hearing both sides, ordered the respondent to decide the pending appeal within four months of the production of a certified copy of the order. The order effectively compels the administrative authority to act expeditiously, thereby granting the relief sought by the petitioner.
