Allahabad High Court

ASHOK CHAUHANversusUNION OF INDIA AND 4 OTHERS

Decided

Holding

The Court held that it will not order the disposal of the pending passport application and the petitioner must file a fresh application as per the guidelines.

Summary

Ashok Chauhan filed a writ petition under Article 226 seeking a court order directing the Regional Passport Officer to dispose of his pending passport application. The respondents argued that the application had been closed because the petitioner failed to respond to a show‑cause notice, and that he could file a fresh application. The Court declined to intervene and order disposal of the pending application, holding that the petitioner is free to submit a new application in accordance with established guidelines. It referred the petitioner to the procedural directions laid down in the recent judgments of Rahimuddin v. Union of India and Wajiruddin Khan v. Union of India. Consequently, the petition was disposed of without granting any relief.
