Allahabad High Court

RAMNATHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that mandamus may be issued directing the Sub‑Divisional Officer to decide the pending revenue case within three months.

Summary

The petitioner, Ramnath, filed a writ petition seeking a mandamus directing the Sub‑Divisional Officer (Judicial) Koraon, Prayagraj, to decide a revenue case (RST/1950/2026) pending under Section 38(1) of the U.P. Revenue Code, 2006 since 27 October 2014. The petitioner argued that the delay violated statutory timelines and sought expeditious disposal. The State’s standing counsel raised no objection to the direction. The Court, after hearing both sides, disposed of the petition by issuing a direction that the Sub‑Divisional Officer decide the pending case within three months of the certified copy of the order. The order effectively granted the relief sought, mandating timely adjudication of the revenue matter.
