The High Court directed the lower court to decide the suit within three months, fixing short dates on a weekly basis.
Summary
Petitioner Smt. Shivpatti Devi filed a writ petition under Section 34 of the U.P. Revenue Code, 2006, seeking expeditious disposal of Suit No.19022 of 2026 (Shivpatti v. Kedarnath Tripathi). The petition highlighted that the lower court had only fixed general dates and had not set a timeline for hearing, causing delay. The petitioner argued that only one opposite party (respondent No.3) was involved and that the proceedings were summary in nature. The High Court, noting that both parties and counsel were present and that the matter required speedy resolution, directed the lower court to decide the suit within three months, fixing short dates preferably on a weekly basis and ensuring opportunities for hearing. The order was made subject to the cooperation of the parties and their lawyers.
