Allahabad High Court

MOHD. DANISHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that the licence was cancelled after a proper inquiry and not merely on the basis of the FIR, and therefore the cancellation was within the authority’s jurisdiction.

Summary

The petitioner, a fair‑price shop licensee, was inspected on 11 January 2024 and a discrepancy was found between the physical stock of wheat, rice and bajra and the entries in the stock register. The licensing authority suspended the licence, sought an explanation, and after the petitioner’s reply and further inquiry—including statements from card‑holders and the petitioner’s failure to produce the distribution register—cancelled the licence on 3 July 2024. The petitioner challenged the cancellation, arguing that it was based solely on the filing of an FIR under Section 3/7 of the Essential Commodities Act and that the weight‑difference explanation (51 kg vs 50 kg per sack) was reasonable. The respondents contended that the cancellation was the result of a detailed inquiry that considered the inspection report, the petitioner’s unsatisfactory explanation, and card‑holder testimonies. The Court held that the authority acted within its jurisdiction, that the cancellation was not predicated merely on the FIR, and that the petitioner’s explanation was vague and unsupported. Consequently, the writ petition was dismissed.

Issues considered

  • Whether the cancellation of the fair‑price shop licence was based solely on the FIR under the Essential Commodities Act or on a substantive inquiry.
  • Whether the licensing authority complied with principles of natural justice and due process in cancelling the licence.
  • Whether the petitioner’s explanation of the weight discrepancy is sufficient to defeat the cancellation.
  • Whether a writ of certiorari lies to set aside the licence cancellation.

Court No. - 36

            HON'BLE SAURABH SHYAM SHAMSHERY, J.

1. Petitioner before this Court was a fair price shop licensee. A
surprise inspection of petitioner’s fair price shop was conducted on
11.01.2024 and stock of foodgrains available in shop was weighed
and when it was compared with stock register, it was found that 2.94
quintal wheat was in excess, 3.39 quintal rice was less and similarly
1.54 quintal Bajra was also less. Accordingly, vide an order dated

                                                                     Writ C No. 35345 of 2026

13.01.2024, licence of petitioner’s fair price shop was suspended and
he was asked to submit his reply on above discrepancy in stock.

2. Petitioner submitted a reply dated 09.02.2024 and relevant part
thereof is mentioned hereinafter:

3. The Licensing Authority recorded statements of few card
holders on 25.04.2024 and sought Distribution register from the
petitioner, however, it was not provided. According to statements

                                                                    Writ C No. 35345 of 2026

recorded, it was found that about 21 card holders have stated that
complete quantity of foodgrains were not provided.

4. In aforesaid circumstances, when there was a clear violation of
conditions of licence, there was a mismatch in weight of stock found
on inspection with stock register, even distribution register was not
provided, there were statements of card holders that irregularities
were committed, therefore, Licensing Authority vide an order dated
03.07.2024 cancelled fair price shop licence of petitioner.

5. Petitioner thereafter preferred an appeal, however, same was
dismissed vide an order dated 29.05.2026 and relevant part thereof is
mentioned hereinafter:

                                                                  Writ C No. 35345 of 2026

6. Both aforesaid orders dated 03.07.2024 and 29.05.2026 are
impugned in present writ petition.

7. Sri Meraj Ahmad Khan, learned counsel for petitioner, has
reiterated explanations submitted by the petitioner during inquiry,
that licence was cancelled only on a ground that a First Information
Report was lodged against petitioner under the provisions of
Essential Commodities Act and appeal was also dismissed on same
ground. Learned counsel also referred a possible explanation to the
mismatch of foodgrains during weighing.

8. Per contra, Sri Prabhakar Tripathi, learned Standing Counsel
appearing for State-Respondents and Sri Arun Kumar Pandey,
Advocate for Respondent-4, have supported the impugned order that
it was not a case where only on basis of a First Information Report,
licence was cancelled, but it was cancelled on basis of an
independent inquiry wherein not only surprise inspection report was
taken note of but statements of card holders were also considered and
explanation of petitioner was found unsatisfactory.

                                                     Writ C No. 35345 of 2026

9. I have considered aforesaid submissions and perused material
on record.

10. An argument of learned counsel for petitioner that cancellation
of licence was only on basis of a fact that a First Information Report
was lodged against petitioner under Section 3/7 of Essential
Commodities Act and appeal was also dismissed on same ground,
cannot be accepted since it is against the record.

11. The order passed by Appellate Authority has already been
reproduced in earlier part of this judgment that not only the
inspection report was relied on but explanation submitted by
petitioner was also found unsatisfactory and in addition to it
statements of card holders were also recorded and relied on.
Therefore, it was not a case where the action was taken only on basis
of a fact that a First Information was lodged against petitioner.

12. So far as other argument is concerned, the Court finds that
physical inspection has not been denied. Weight of stock available
was also not specifically denied. Distribution Register was also not
produced despite repeatedly sought and this fact has also not
specifically denied. There is no denial even to the statements of card
holders recorded, being part of impugned orders.

13. The explanation that a bag of foodgrains was of 51 KG and not
of 50 KG is an explanation as vague as possible. No documentary
evidence was produced either before Licensing Authority or before
Appellate Authority and even before this Court in support of above
explanation. On basis of such nature of explanation, impugned
orders, which are passed on basis of material on record after
                                       8
                                                          Writ C No. 35345 of 2026

considering inspection report, explanation and statements of
cardholders cannot be interfered.

14. In this regard the Court takes note of a judgment passed by
Supreme Court in Central Council for Research in Ayurvedic
Sciences and another vs. Bikartan Das and others, 2023 SCC Online
SC 996 wherein scope of writ of certiorari is discussed and relevant
part thereof is mentioned hereinafter:

“65. Thus, from the various decisions referred to above, we have
no hesitation in reaching to the conclusion that a writ of certiorari
is a high prerogative writ and should not be issued on mere
asking. For the issue of a writ of certiorari, the party concerned
has to make out a definite case for the same and is not a matter of
course. To put it pithily, certiorari shall issue to correct errors of
jurisdiction, that is to say, absence, excess or failure to exercise
and also when in the exercise of undoubted jurisdiction, there has
been illegality. It shall also issue to correct an error in the decision
or determination itself, if it is an error manifest on the face of the
proceedings. By its exercise, only a patent error can be corrected
but not also a wrong decision. It should be well remembered at the
cost of repetition that certiorari is not appellate but only
            supervisory.
            66. A writ of certiorari, being a high prerogative writ, is issued by
a superior court in respect of the exercise of judicial or quasi-
judicial functions by another authority when the contention is that
the exercising authority had no jurisdiction or exceeded the
jurisdiction. It cannot be denied that the tribunals or the
authorities concerned in this batch of appeals had the jurisdiction
to deal with the matter. However, the argument would be that the
tribunals had acted arbitrarily and illegally and that they had failed
to give proper findings on the facts and circumstances of the case.
We may only say that while adjudicating a writ-application for a
writ of certiorari, the court is not sitting as a court of appeal
against the order of the tribunals to test the legality thereof with a
view to reach a different conclusion. If there is any evidence, the
court will not examine whether the right conclusion is drawn from
it or not. It is a well-established principle of law that a writ of
certiorari will not lie where the order or decision of a tribunal or
                                                                         9
