Allahabad High Court

FIRERAMversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that the Special Land Acquisition Officer must decide the petitioner's application within two months from the date of the order, after providing a hearing to the parties.

Summary

The petitioner, Fireram, filed a writ petition seeking a mandamus directing the Special Land Acquisition Officer (Sanyukta Sangathan) of Bulandshahar to consider and decide his land acquisition application dated 17 July 2012 within the time prescribed by law. The respondents contended that the application would be decided within two months from the date of the hearing. The Court examined whether the officer was obligated to act within a reasonable time and whether a writ of mandamus could be issued to compel such action. Relying on principles of administrative law, the Court held that the officer must decide the application within a specified period. Accordingly, the petition was disposed with an order directing the officer to decide the application within two months, after granting a hearing to the parties.
